These Terms of Service ("Terms") govern your access to and use of the ScamSense mobile application (the "App") and website at scamsenseapp.com (the "Website"), collectively referred to as the "Service." By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By downloading, installing, or using ScamSense, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and ScamSense.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

ScamSense is an AI-powered scam detection application that helps users identify potentially fraudulent messages, URLs, and content through:

• Text Analysis: Paste suspicious text messages (SMS, WhatsApp, email content, social media messages) for AI-powered scam risk assessment.
• Screenshot Scanning: Upload screenshots of suspicious content for OCR-powered text extraction and analysis.
• Link Checking: Submit URLs for safety analysis, checking against known threat databases and AI-based pattern detection.
• Community Reports: Browse and contribute to community-generated scam reports to help protect others.
• Scam Trend Radar: View real-time scam trends and patterns based on aggregated, anonymized community data.

3. Eligibility

• You must be at least 13 years of age to use the Service.
• If you are between 13 and 18 years old, you must have parental or guardian consent to use the Service.
• You must provide accurate and complete information when creating an account.
• You must comply with all applicable laws and regulations in your jurisdiction.

4. User Accounts

4.1 Registration

Some features require account creation. You agree to provide accurate, current, and complete registration information and to keep this information updated.

4.2 Account Security

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately at sales@xigmapro.com if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4.3 Account Deletion

You may delete your account at any time through the App settings or by contacting us. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

5. Free and Premium Plans

5.1 Free Plan

ScamSense offers a free tier with limited daily scans. Free users have access to core features including text scanning, screenshot analysis, and community reports.

5.2 Premium Plan

• Premium subscriptions unlock unlimited scans, priority analysis, advanced features (Scam Trend Radar, detailed threat breakdowns), and ad-free experience.
• Premium pricing and features are displayed in the App at the time of purchase.
• Subscriptions are billed through Google Play Store and are subject to Google's billing terms.

5.3 Refunds

Refund requests for Premium subscriptions are handled through the Google Play Store in accordance with Google's refund policy. For billing inquiries, contact us at sales@xigmapro.com.

6. Acceptable Use

You agree not to use the Service to:

• Submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Attempt to reverse-engineer, decompile, or disassemble the App or its algorithms.
• Use automated tools, bots, or scripts to access or interact with the Service.
• Interfere with or disrupt the Service's infrastructure or other users' access.
• Submit false or misleading scam reports intentionally.
• Use the Service to facilitate, promote, or engage in any fraudulent or scam activity.
• Violate any applicable laws, regulations, or third-party rights.
• Attempt to access other users' accounts or data without authorization.
• Use the Service for commercial purposes without written permission.

7. Intellectual Property

7.1 Our Rights

The Service, including its design, code, algorithms, graphics, logos, trademarks, and content, is owned by ScamSense and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written consent.

7.2 User Content

You retain ownership of content you submit for scanning. By using the Service, you grant us a limited, non-exclusive license to process your submitted content solely for the purpose of providing the scam detection service. This license terminates when the content is processed and discarded.

7.3 Community Reports

By submitting public scam reports, you grant ScamSense a non-exclusive, royalty-free license to display, distribute, and use the report content to help protect other users from scams.

8. Disclaimers

8.2 Not Legal or Financial Advice

The Service does not constitute legal, financial, or professional advice. If you believe you have been a victim of fraud, contact your local law enforcement, your bank, and relevant consumer protection agencies.

8.3 "As Is" Basis

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.4 Third-Party Content

The Service may display or link to third-party content. We do not endorse, verify, or assume responsibility for third-party content, products, or services.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• ScamSense shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• ScamSense shall not be liable for any financial losses resulting from scams that were not detected by the Service.
• Our total liability shall not exceed the amount you paid for Premium subscriptions in the 12 months preceding the claim.
• These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).

10. Indemnification

You agree to indemnify and hold harmless ScamSense, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any third-party rights.
• Content you submit through the Service.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will use reasonable efforts to provide advance notice for significant changes. We shall not be liable for any modification, suspension, or discontinuation of the Service.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

• We will update the "Last Updated" date at the top of this page.
• We may notify you via in-app notification or email.
• Continued use of the Service after changes constitutes acceptance of the revised Terms.

If you do not agree with updated Terms, you must stop using the Service and may delete your account.

13. Termination

• By You: You may stop using the Service and delete your account at any time.
• By Us: We may suspend or terminate your access if you violate these Terms, engage in harmful activity, or if required by law.
• Effect of Termination: Upon termination, your right to use the Service ceases. Sections 7–10 and 14–15 survive termination.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes will be submitted to binding arbitration or the appropriate courts in the jurisdiction where ScamSense operates.

15. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and ScamSense.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
• Waiver: Failure to enforce any provision is not a waiver of that provision.
• Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
• Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
